OFFICIAL RULES<\/strong><\/p>\n\n\n\n

NO PURCHASE, PAYMENT, OR CONTRIBUTION NECESSARY. A PURCHASE, PAYMENT, OR CONTRIBUTION OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.<\/p>\n\n\n\n

1. Eligibility:<\/strong> NHCOA\u2019s 2023 Annual Awards Ceremony Giveaway (the \u201cPromotion\u201d) is open only to legal citizens worldwide who have reached the age of majority in their jurisdiction as of the start of the Promotion Period. Directors, officers, and employees of the National Hispanic Council on Aging (\u201cNHCOA), Apple Inc. and Meta Platforms, Inc. (Facebook), and any of their immediate family members (spouse, parent, child, sibling, and their respective spouses), and persons living in the same household (whether related or not) are not eligible to enter the Promotion or to win a prize. The Promotion is subject to all applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED.<\/p>\n\n\n\n

2. Sponsor:<\/strong> National Hispanic Council on Aging (NHCOA), 2201 12th St. NW, Suite 101, Washington, DC 20009.<\/p>\n\n\n\n

3. Agreement to Official Rules:<\/strong> By participating in the Promotion, each participant acknowledges that they have read, understand, and agree to be bound fully and unconditionally to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion. By submitting an entry, each participant warrants that their entry complies with all the requirements set out in these Official Rules.<\/p>\n\n\n\n

4. Timing:<\/strong> The Promotion begins on November 21, 2023 at 8:00 a.m. Eastern Standard Time (\u201cEST\u201d) when the Event was first posted on Facebook, and ends on December 7, 2023 at 8:00 p.m. EST (the \u201cPromotion Period\u201d). Sponsor\u2019s computer is the official time-keeping device for the Promotion.<\/p>\n\n\n\n

5. How to Enter:<\/strong> All eligible participants who wish to enter the Promotion must:<\/p>\n\n\n\n

  1. Like NHCOA\u2019s Facebook official page (https:\/\/www.facebook.com\/NHCOA<\/a>), AND<\/li>\n\n\n\n
  2. RSVP to NHCOA\u2019s \u201c2023 Annual Awards Ceremony: Celebrating our Diversity\u201d event (the \u201cEvent\u201d) on Facebook (https:\/\/www.facebook.com\/events\/910218663949355<\/a>) as either Going or Interested prior to the start of the Event (December 7, 2023 at 6:00 pm EST), AND<\/li>\n\n\n\n
  3. Join the Event virtually via Facebook Live on Thursday, December 7, 2023, beginning at 6:00 p.m EST, AND<\/li>\n\n\n\n
  4. Post a comment on the Event\u2019s Facebook Live event page that answers a question posed by the Event host during the Event that is clearly identified by the host as the question to which Promotion participants should answer for entry in the Promotion (the \u201cComment\u201d). The Comment must not contain text or imagery that could reasonably be considered inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, or unlawful. Only one entry per eligible participant will be accepted. Each entry shall be deemed submitted by the owner of the applicable Facebook account.<\/li>\n<\/ol>\n\n\n\n

    6. Prize:\u00a0<\/strong>After the conclusion of the Event but no later than December 11, 2023, Sponsor will select one (1) eligible participant via a random online name generator to win the prize. The prize consists of a pair of brand-new AirPods (3rd Generation) by Apple Inc. The retail value of the prize is $179 plus tax. The prize is not transferable, nor are there substitutions or cash redemptions, except at Sponsor\u2019s discretion if the prize becomes unavailable.<\/p>\n\n\n\n

    7. Winner Notification and Requirements:<\/strong> Sponsor will contact the winner by Facebook message to the Facebook account associated with the winning entry on or around December 10, 2023. Except where prohibited, the winner will be required to sign and return a Declaration of Compliance, Liability and Publicity Release, which must be received by Sponsor within five (5) days of the date notice or attempted notice is sent, in order to claim his\/her\/their prize. If the winner cannot be contacted, fails to execute and return the Declaration of Compliance, Liability and Publicity Release or provide any other requested information within the required time period (if applicable), or the prize is returned as undeliverable, the prize may be forfeited and awarded to an alternative winner selected at random from the remaining eligible participants.<\/p>\n\n\n\n

    8. Chances of Winning<\/strong>: The odds of winning are dependent on the number of eligible entries received.<\/p>\n\n\n\n

    9. Publicity:<\/strong> The winner hereby grants Sponsor the right to use their name and likeness in promotional materials relating to the Event and the Promotion, without the need for additional permission.<\/p>\n\n\n\n

    10. No Association:<\/strong> Each entrant understands that this Promotion is in no way sponsored, endorsed by, administered by, or associated with Apple Inc. or Meta Platforms, Inc. (Facebook).<\/p>\n\n\n\n

    11. Release:<\/strong> By entering this Promotion, all entrants agree to release and hold harmless Sponsor, Apple Inc., and Meta Platforms, Inc. (Facebook), and each of their respective parents, subsidiaries, affiliates, suppliers, distributors, advertising\/promotion agencies, and prize suppliers, and each their officers, directors, employees and agents (collectively, the \u201cReleased Parties\u201d) from and against any and all claims, causes of action, losses, damages, and liabilities arising out of their participation in this Promotion and the acceptance of any prize awarded hereunder, including, but not limited to, personal injury, death, or damage to or loss of property.<\/p>\n\n\n\n

    12. General Conditions:<\/strong> Sponsor reserves the right to cancel, suspend and\/or modify the Promotion if any fraud, technical failures, human error, any other factor impairs the integrity or proper functioning of the Promotion, or any event or cause beyond Sponsor\u2019s control (e.g. events such as natural calamities, national emergencies, widespread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Promotion, including but not limited to fulfillment of the prize, as determined by Sponsor in its sole discretion. If the Promotion is terminated, Sponsor may, in its sole discretion, determine the winner from among all non-suspect, eligible submissions received up to time of such action using the selection procedure outlined above. In addition, Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys\u2019 fees) from any such person to the fullest extent permitted by law. Sponsor\u2019s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.<\/p>\n\n\n\n

    13. Limitations of Liability:<\/strong> Released Parties are not responsible or liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical problems, malfunctions of computer systems, servers, providers, hardware\/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof; (3) unauthorized human intervention in any part of the submission process for the Promotion; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Promotion, the uploading of submissions, the processing or selecting a winner, the announcement of the winner or in any Promotion-related materials; (5) late, lost, illegible, misdirected, incomplete, undeliverable, damaged or stolen entries; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant\u2019s participation in the Promotion or receipt or use or misuse of any prize, orfor any (7) any unauthorized third-party use of any Comments.<\/p>\n\n\n\n

    14. Winner\u2019s List<\/strong>: Only the winner will be notified of the Promotion outcome, but you may request a winner\u2019s list for the Promotion by sending a written request to Sponsor at the address stated above, which is received by Sponsor no later than June 30, 2024.<\/p>\n\n\n\n

    15. Other Important Information:<\/strong> Entries become the property of the Sponsor and will not be returned. Sponsor may use the Comments posted on the Facebook event page for any purpose consistent with Sponsor\u2019s goals and mission without additional permission from each participant. No mechanically reproduced entries or faxes will be accepted. All federal, state, and local taxes associated with the receipt or use of the prize are the sole responsibility of the winner. The information Sponsor collects about entrants through this Promotion will be used for purposes of this Sweepstakes only. This Promotion shall be governed by the laws of the District of Columbia, without regard to its conflict of law rules. The forum for any dispute shall be in the District of Columbia.<\/p>\n\n\n\n
